Entire Agreement

These Terms of Service — including the SMS & Text Message Communications terms set forth in the SMS section — together with our Privacy Policy, constitute the entire agreement between you and Avid Urgent Care regarding your use of our website and services, and supersede all prior agreements, understandings, or representations, whether oral or written. No oral representations or prior agreements regarding SMS communications shall be binding unless incorporated into a written amendment to these Terms.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable for any reason, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions.

8.1 Program Description

Avid Urgent Care (“Company,” “we,” “our”) operates an SMS text messaging program for direct, two-way operational and customer care communication with clients. This program is not a promotional or marketing campaign. Messages are sent only in direct response to, or as a necessary part of, an active customer inquiry, transaction, or service request.

8.2 Express Written Consent

By providing your mobile telephone number and affirmatively checking the SMS consent checkbox on any Avid Urgent Care form (contact, registration, or inquiry), you provide express written consent to receive text messages from Avid Urgent Careat the mobile number provided. This consent is voluntary. Consent to receive SMS messages is not a condition of purchasing any product or service from Avid Urgent Care. Standard message and data rates may apply.

8.3 Permitted Message Types

By consenting to SMS communications, you may receive the following types of messages:

• Direct replies to questions or inquiries you submitted through our website or support channels
• Appointment confirmation, processing status, and scheduling notification messages
• Scheduling confirmations or changes for appointments you have arranged

Avid Urgent Care does not send unsolicited promotional, advertising, or marketing text messages to SMS subscribers.

8.4 Message Frequency and Rates

Message frequency varies based solely on the nature and volume of your interactions with Avid Urgent Care. We do not operate a scheduled or automated broadcast messaging program. All messages are sent only in response to or as part of an active customer interaction. Standard message and data rates may apply. Avid Urgent Care is not responsible for any charges imposed by your wireless carrier.

8.5 How to Opt Out

You may revoke your consent and opt out of receiving SMS messages at any time by:

• Replying STOP to any text message from us. Upon receipt, we will send a single confirmation and no further messages will be sent to that number.
• Emailing [email protected] with a written opt-out request.
• Calling us during business hours (Monday–Friday, 9am–5pm CST) — see contact information in our footer.

Opt-out requests will be processed within one (1) business day. You may re-enroll at any time by re-submitting the consent checkbox on any form.

8.7 No Third-Party Sharing of SMS Data

Avid Urgent Care does not sell, rent, or share your mobile phone number or SMS opt-in consent data with any third party for marketing, advertising, or promotional purposes. Your mobile number and consent records may be disclosed solely to subcontractors providing direct operational support for our SMS program (e.g., our SMS platform provider), under written confidentiality agreements that prohibit any use of the data beyond facilitating message delivery. All text messaging originator opt-in data and consent records are expressly excluded from any third-party data-sharing arrangement.

8.8 Program Modification or Termination

Avid Urgent Care reserves the right to modify or discontinue the SMS messaging program at any time. In the event of program termination, enrolled users will receive advance notice via a final text message before the program is discontinued.
